Terms of Service

These Terms of Service ("Terms") apply to the bevipclub.app website, the BeVIP app, and BeVIP text messages, all provided by BeVIP LLC ("BeVIP", "we", "us"). By using them, you agree to these Terms.

1. The service

BeVIP provides a membership app that businesses ("Businesses") use to run their own VIP clubs. Each Business sets its own plans, prices, perks and policies, and is responsible for the services it provides to its members. BeVIP is not a party to the agreement between a member and a Business.

2. Accounts

You must give accurate information and keep your login safe. You are responsible for activity on your account. You must be at least 18 years old, or have a parent's or guardian's permission.

3. Memberships and payments

Membership payments are made to the Business through its payment provider (Stripe). Renewals, cancellations, refunds and unused credits follow the Business's own policy. Questions about a membership charge should go to the Business first.

4. Businesses using BeVIP

Businesses that subscribe to BeVIP agree to a separate client agreement covering fees, setup, usage allowances and billing. If that agreement conflicts with these Terms, the client agreement controls for the Business.

5. Text messages

By opting in, you agree to receive recurring marketing and informational text messages from BeVIP or the Business whose club you joined. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help, or contact [EMAIL]. Carriers are not liable for delayed or undelivered messages.

6. Acceptable use

Do not misuse the service: no breaking the law, sending spam, accessing accounts that aren't yours, interfering with the app, or copying it.

7. Our content

The BeVIP name, logo, app and website belong to BeVIP LLC. Businesses keep ownership of their own logos and content.

8. Disclaimers

The service is provided "as is" and "as available". We do not promise it will always be available or error-free. BeVIP does not provide medical, beauty or other professional services and is not responsible for the services Businesses provide.

9. Limit of liability

To the extent allowed by law, BeVIP is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid BeVIP in the 12 months before the claim.

10. Ending use

You may stop using the service at any time. We may suspend or close accounts that break these Terms.

11. Changes

We may update these Terms. We will change the date above, and continued use means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the State of [STATE], USA, except where the law of your country gives you rights that cannot be waived.
